What is Elder Abuse?
Elder abuse is the neglect, exploitation, or harmful mistreatment of anyone who is 65 years of age or older. California law defines elder abuse as either of the following:
• Physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or other treatment with resulting physical harm or pain or mental suffering, or
• The deprivation by a care custodian of goods or services that are necessary to avoid physical harm or mental suffering.
Types Of Elder Abuse
Nearly any behavior leading to harm, pain or mental suffering of a vulnerable senior may qualify as elder abuse, whether those results were intended or not.
Physical abuse might include any of the following:
• battery
• sexual assault
• rape
• prolonged deprivation of food or water
• excessive use of physical or chemical restraints for punishment or convenience.
• failure to provide proper nutrition and hydration
• failure to assist in personal hygiene (cleaning, bathing, bathroom help, etc.)
• unsanitary and unclean conditions
• over-medication or under-medication
• failure to take reasonable precautions to prevent falls or other safety hazards
• failure to turn the bedridden senior to prevent bed sores
• failure to treat injuries, infections, and other ailments
• failure to change bandages, bed sheets, undergarments, etc.
Financial abuse can be inflicted by family members, friends, caretakers, nursing homes and other care facilities that rob the elder of assets and property that rightfully belong to him or her. Financial abuse can occur in many different ways. Some examples include:
• stealing checks
• using the victim’s money or property without permission for personal use
• fraudulent or wrongful changes to wills and trusts
• credit card fraud
• improper influence over the elder to make financial decisions
Psychological abuse includes the use of intimidation to instill fear and/or confusion in an elder individual. It includes any of the following types of behavior:
• threatening the victim
• harassing the victim
• blaming the victim
• humiliating the victim
• insulting the victim
• ignoring the victim
• isolating the victim from human contact
Signs of Elder Abuse
It is important to recognize the signs of elder abuse. If you observe any of these characteristics in your loved one, you should seek help to determine if any abuse is occurring:
• unexplained injuries (bruises, contusions, skin tears, cuts, broken bones, etc.)
• dehydration
• bedsores
• repeated falls
• personality changes (disorientation, depression)
• unclean conditions
• untreated medical condition
• isolation
• unusual bank activity
• changes in spending patterns, will, trusts, or financial documents
