What Is Fraud?

Fraud costs hundreds of millions of dollars every year and affects millions of people. Simply defined, fraud is intentional deception and misrepresentation to gain something of value. Under California law, there are three different types of fraud:

• Deceit, which is the willful deception of another with the intent to induce the other to alter his or her position to his or her injury.

• Actual fraud, which is an act committed by a party to a contract with the intent to deceive the other party in order to induce that party to enter into the contract by the suggestion or assertion of a fact that is known or should have been known to be untrue. It can also involve the suppression of a true fact by one who is bound to disclose it, or a promise made without any intention of performing it.

• Constructive fraud, which consists of any breach of duty in which one person gains an advantage over another by misleading statements or actions, even if actual fraud is not intended.

Consumer Fraud In California

Consumer fraud is an increasingly common injury inflicted upon millions of unsuspecting victims. It exists when a consumer buys something (merchandise or services) that is not or does not function as advertised. In order to counter this huge problem, the California legislature passed the Unlawful Business Practices Act. Under this law, an unfair business practice consists of advertising or performing any other action that is:

• unlawful
• unfair
• fraudulent
• deceptive
• untrue or misleading

Many companies engage in deliberate unfair, unlawful, or fraudulent practices in order to make a profit. However, California’s law gives consumers the right to recover damages whenever an unfair business practice has occurred. The types of damages a consumer can sue for include the following:

• the amount of money the consumer paid for the goods or services that were fraudulently marketed,

• any other losses or costs the consumer incurred because of the fraudulent or deceptive advertising, and

• attorney fees and court costs
